Terms of Service

Welcome to Service Engine. These Terms of Service ("Terms") govern your access to and use of the Service Engine platform, including our website, dashboard, APIs, SMS messaging features, AI agent, and booking tools (collectively, the "Service").
By creating an account or using Service Engine, you agree to be bound by these Terms. If you do not agree, do not use the Service. "We," "us," and "our" refer to Service Engine. "You" and "your" refer to you, the business or individual using the Service.
1. Platform Description
Service Engine is a software-as-a-service (SaaS) platform designed for local service businesses such as salons, barbershops, spas, personal trainers, cleaning services, and similar appointment-based businesses. The platform provides the following core capabilities:
- Online Booking -- A public booking page where your clients can view your services, select an available time slot, and schedule an appointment without needing to call.
- SMS Automation -- Automated text messages including appointment reminders (24 hours and 1 hour before), missed-call text-back, no-show follow-ups, and post-appointment messages.
- AI Agent -- An AI-powered virtual receptionist that can answer common questions about your business (hours, services, pricing) and direct clients to your booking page via SMS, available around the clock.
- Shared Inbox -- A unified view of all SMS conversations with your clients, allowing you and your team to read and reply from a single dashboard.
- Review Requests -- Automated text messages sent after completed appointments asking clients to leave a Google review for your business.
The Service is provided "as is" and we continuously improve features, which may result in changes to functionality. We will notify you of any material changes that affect how you use the platform.
2. Account Terms
To use Service Engine, you must create an account. Accounts are managed through our authentication provider (Clerk) and are organized as follows:
- One business per account. Each Service Engine account represents a single business location. If you operate multiple locations, each requires its own account and subscription.
- Organization-based access. Your account is tied to an organization. You may invite team members to your organization, and all members will share access to the same business dashboard, inbox, and client data.
- Accurate information. You must provide accurate and complete information when creating your account, including your business name, phone number, and contact details. You are responsible for keeping this information up to date.
- Account security. You are responsible for maintaining the security of your account credentials. You must notify us immediately if you suspect unauthorized access. We are not liable for any loss resulting from unauthorized use of your account.
- Age requirement. You must be at least 18 years old and have the legal authority to enter into these Terms on behalf of your business.
3. Billing & Payments
Service Engine offers two subscription plans, billed monthly:
- Starter -- $149/month. Includes online booking, appointment reminders, missed-call text-back, shared SMS inbox, client management, and up to 500 SMS messages per month.
- Pro -- $249/month. Includes everything in Starter plus the AI receptionist, automated review requests, post-appointment and no-show follow-ups, up to 2,000 SMS messages per month, and priority support.
Additional billing terms:
- Payment processing. All payments are processed securely through Stripe. By subscribing, you agree to Stripe's Terms of Service.
- Auto-renewal. Your subscription automatically renews each month on the anniversary of your start date. You will be charged at the beginning of each billing cycle.
- Cancellation. You may cancel your subscription at any time from the Settings page in your dashboard. Cancellation takes effect at the end of your current billing period. You will retain access to the platform until your paid period expires.
- Refunds. We do not offer prorated refunds for partial billing periods. If you cancel mid-cycle, you will continue to have access through the end of the period you have already paid for. In cases of billing errors or service outages exceeding 48 consecutive hours, we will issue a prorated credit at our discretion.
- Overage charges. If you exceed your plan's SMS limit, additional messages are billed at $0.03 per message. We will notify you when you reach 80% of your monthly limit.
- Price changes. We reserve the right to change subscription pricing. We will provide at least 30 days' notice before any price increase takes effect on your account. You may cancel before the new pricing applies.
4. SMS & Messaging
Service Engine sends and receives SMS messages on your behalf using the Twilio messaging platform. By using our SMS features, you agree to the following:
- TCPA compliance is your responsibility. You must comply with the Telephone Consumer Protection Act (TCPA) and all applicable federal, state, and local laws governing text messaging. This includes, but is not limited to, obtaining prior express written consent from each recipient before sending them marketing or promotional messages.
- Consent collection. When a client books an appointment through your booking page, we collect their consent to receive appointment-related messages (confirmations, reminders, follow-ups). You are responsible for ensuring you have appropriate consent for any additional marketing or promotional messages you send through the platform.
- Opt-out handling. Service Engine automatically processes STOP requests. When a client texts STOP, they are immediately opted out and no further messages will be sent to that number. You must not attempt to circumvent this opt-out mechanism or contact opted-out individuals through other means based on data obtained from our platform.
- A2P messaging regulations. All messages sent through Service Engine are Application-to-Person (A2P) messages. You acknowledge that carrier filtering, delivery delays, and message blocking may occur. We do not guarantee delivery of any individual message. You are responsible for registering your use case with applicable carrier programs as required.
- Message content. You are solely responsible for the content of messages you send. You must not use our messaging features to send spam, phishing attempts, fraudulent content, threats, harassment, or any content that violates applicable law.
- Message volume. Your plan includes a monthly SMS allocation (500 for Starter, 2,000 for Pro). This includes both automated messages (reminders, follow-ups, review requests, AI responses) and manual messages sent from the inbox.
5. AI Agent
The AI Agent feature (available on the Pro plan) uses artificial intelligence to automatically respond to inbound text messages from your clients. The AI is powered by Anthropic's Claude language model. By enabling the AI Agent, you agree to the following:
- AI-generated responses. Responses sent by the AI Agent are generated automatically based on the business information, services, hours, and FAQs you configure in your dashboard. While the AI is designed to be helpful and accurate, it may occasionally produce incorrect, incomplete, or inappropriate responses.
- No guarantee of accuracy. We do not guarantee the accuracy, completeness, or appropriateness of any AI-generated response. The AI Agent is a tool to assist your business, not a replacement for human judgment or professional advice.
- Your responsibility. You are responsible for configuring the AI Agent with accurate business information, monitoring its conversations (visible in your Shared Inbox), and correcting any errors. You are also responsible for any actions your clients take based on AI-generated responses.
- Response guidelines. The AI Agent is configured to provide short, SMS-appropriate responses (typically 1 to 3 sentences). It is designed to answer questions about your business hours, services, and pricing, and to direct clients to your booking page. It will not provide medical, legal, financial, or other professional advice.
- AI logging. All AI Agent conversations are logged for quality assurance and to help you review interactions. These logs are accessible in your dashboard and are subject to the same data handling practices described in our Privacy Policy.
6. Data & Privacy
Your privacy and the privacy of your clients matters to us. Our data practices are governed by our Privacy Policy, which is incorporated into these Terms by reference. Key points include:
- Data storage. Your business data, client information, appointment records, conversations, and AI logs are stored securely in our database infrastructure powered by Supabase (PostgreSQL). Data is encrypted in transit and at rest.
- Data isolation. All data is isolated by business account. Row-level security policies ensure that your data is accessible only to authenticated members of your organization. No other business using Service Engine can access your data.
- Client data. You are the data controller for your clients' personal information (names, phone numbers, email addresses, appointment history). You are responsible for complying with applicable privacy laws regarding the collection and use of this data, including providing appropriate privacy notices to your clients.
- Data processing. We act as a data processor on your behalf. We process client data only as necessary to provide the Service (sending messages, scheduling appointments, generating AI responses). We do not sell or share your data with third parties for their marketing purposes.
- Third-party services. The Service integrates with third-party providers including Twilio (SMS delivery), Anthropic (AI processing), Stripe (payment processing), and Clerk (authentication). Each of these providers has their own privacy policies and terms. Data shared with these providers is limited to what is necessary for their function.
7. Acceptable Use
You agree to use Service Engine only for lawful purposes and in accordance with these Terms. You must not:
- Send unsolicited bulk messages (spam) or messages to individuals who have not given consent.
- Use the platform to send messages containing illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable content.
- Attempt to circumvent the STOP/opt-out mechanism or re-message recipients who have opted out.
- Use the Service to collect personal information for purposes unrelated to your legitimate business operations.
- Share your account credentials with individuals outside your organization, or resell access to the Service.
- Attempt to interfere with, disrupt, or gain unauthorized access to the Service, its servers, or connected networks.
- Reverse-engineer, decompile, or attempt to extract the source code of the platform.
- Use the Service in a manner that could overload or impair our infrastructure, including exceeding reasonable API call limits.
- Misrepresent your identity, your business, or the nature of your messages to recipients.
- Use the AI Agent to generate content that is misleading, discriminatory, or harmful.
We reserve the right to suspend or terminate your account without notice if we determine, in our sole discretion, that you have violated these acceptable use terms. Violations that result in legal liability, carrier complaints, or reputation damage may result in immediate termination without refund.
8. Intellectual Property
- We own the platform. All rights, title, and interest in the Service Engine platform, including its software, design, branding, documentation, and underlying technology, are owned by Service Engine or our licensors. These Terms do not grant you any ownership rights in the platform.
- You own your business data. You retain full ownership of all content you upload, create, or transmit through the Service, including your business information, client records, message content, and appointment data. We do not claim any ownership of your data.
- Limited license to us. By using the Service, you grant us a limited, non-exclusive license to use, process, store, and transmit your data solely for the purpose of providing and improving the Service. This license terminates when you delete your data or close your account.
- Feedback. If you provide suggestions, feature requests, or other feedback about the Service, we may use that feedback without obligation to compensate you.
9. Limitation of Liability
To the maximum extent permitted by applicable law:
- The Service is provided "as is" and "as available." We make no warranties, express or implied, regarding the Service, including warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted availability.
- No guarantee of message delivery. SMS delivery depends on carrier networks, recipient devices, and other factors outside our control. We do not guarantee that any particular message will be delivered, delivered on time, or delivered without alteration.
- No guarantee of AI accuracy. As described in Section 5, AI-generated responses may be inaccurate. We are not liable for any damages resulting from reliance on AI-generated content.
- Liability cap. Our total cumulative liability to you for all claims arising out of or related to these Terms or the Service, whether in contract, tort, or otherwise, shall not exceed the total amount you paid us in the twelve (12) months immediately preceding the event giving rise to the claim.
- Exclusion of consequential damages. In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, lost clients, lost bookings, or business interruption, regardless of the cause or theory of liability, even if we have been advised of the possibility of such damages.
- Your liability. You are responsible for your use of the Service and agree to indemnify and hold us harmless from any claims, damages, or expenses (including reasonable attorney's fees) arising from your violation of these Terms, your misuse of the Service, your messages or content, or your violation of any law or third-party rights.
10. Termination
- Termination by you. You may cancel your subscription and close your account at any time from the Settings page in your dashboard, or by contacting us at support@serviceengine.app.
- Termination by us. We may suspend or terminate your account if you violate these Terms, fail to pay, engage in activity that harms our platform or other users, or for any reason with 30 days' written notice. In cases of serious violations (spam, illegal activity, fraud), we may terminate immediately without notice.
- Data export after termination. Upon termination, your data will remain available for export for 30 days. During this period, you may contact us to request an export of your business data, client records, appointment history, and message logs. After 30 days, we will permanently delete your data from our systems, except where retention is required by law.
- Effect of termination. Upon termination, your right to access and use the Service ends. All automated messaging (reminders, follow-ups, AI responses) will stop. Your public booking page will be deactivated. Any outstanding balance remains due.
- Survival. Sections relating to intellectual property, limitation of liability, indemnification, and dispute resolution survive termination of these Terms.
11. Changes to Terms
We may update these Terms from time to time to reflect changes in our Service, legal requirements, or business practices. When we make changes:
- We will update the "Last updated" date at the top of this page.
- For material changes (changes to pricing, data handling, or your rights), we will notify you by email at least 15 days before the changes take effect.
- Your continued use of the Service after the effective date of updated Terms constitutes your acceptance of those changes.
- If you do not agree to the updated Terms, you may cancel your subscription before the changes take effect.
